This guy got a piece of junk mail that had a very realistic looking check attached to it. Okay lets say it was us....and you deposited the check as he did and when you check your balance a few days later you now have over 100,000 in your bank account....would you call the bank and tell the truth....or would you keep quiet and spend the money.....


Hmmm good question Kazz....moral issues....what would you do....oh hell....we all know I say screw the system I would keep my mouth shut not buy anything lavish to call attention to myself and just have the time of my life.

I had a bank make a mistake on my account for something like an increase of $1267.00

I guess it's been around 6 years now. I was living in Jackson, Mississippi and paid the full balance on a credit card I had. The full balance I owned was for $12.67, and I made the check out for just that.

About a week later from my local bank I received a notice for "Insufficient Fund" (Anyone ever see one of those?:D ). I looked at the amount and knew I never made or wrote any check for that amount. As you may know the bank was wanting to also charge me like $25 for writing a hot check. I was able to get out of that fee and explained to them that that check was written for $12.67 not $1267.00, and if they'd look at the face of the check they'd know that. They said that when checks clear, they don't go by what the face says, but rather what is printed (stamped) in the back, and that's all they had a image (copy) of.

So I got that mess cleared up with my bank there in Jackson, now it was time to call the bank I had my Credit Card with. Instead of them crediting me the $12.67 that I sent them, they accidentally put in $1267:eek: ! "I had some playing money now!:cool:

I called the CC bank and explained to them that they made an error and what the error was. Then I spoke with a lady in charge and she asked that I fax them a copy of my Jxn bank statement, I did. I spoke to several people, faxed them a statement and they never would correct their mistake:) . So I was left holding the money:p ! I then went out later and bought me a pair of boots that I still wear today, and paid for them with the money the bank never would take back.:p

Do I feel bad? Heck no!!! I did my part and more, I just wish it would have been for $1267000 :D

If they come calling for me today, I'll just tell them that the person that they're looking for in now dead!;)

Hey, that would buy me a couple round trip airplane tickets. Go see the grandkids I would. Or a new computer. What a dilemma! ;)

Depending on how much it was i would keep my mouth shut.

The thing id worry about is the suspision. If all of a sudden i receive a few grand and then spend it in small chunks that'll be ok.

I mean it wasn't my fault that the money is there. I could say that a family member made a suprise deposit for me:)

But in the end temptation would win for me:D

I don't think the same situation would count in the UK due to the difference in banking laws.
If you spent/withdrew an amount of money from your account that you knew should not be there then you would end up having to pay it back.
If memory serves large amounts of legitimate cash have been paid into wrong accounts before and ended up having to be repaid [with no reward I might say].

Much like when you deposit a cheque although the banks allow you to spend it straight away,you will be required to repay the full amount should it fail to clear.Which can be anything from SEVEN or more working days later.

hmm, cashing a check without endorsing it! Cashiers anymore don't even look for a signiture. What a great banking system we have.;)

Sorry guys but,

by keeping your mouth shut you are committing a criminal offence because you know you shouldn't have the money and therefore Mens Rea is complete. - Go directly to jail and do not pass go.

In the uk you would be charged with 'obtaining cash by deception' and 'using a false instrument' namely the cheque. However if you report the fault to the bank (and have proof of doing so) and they do nothing about it then no criminal offence would be committed but it would still remain as a civil debt between you and then bank and you would still be the looser at the end of the day because you would have to repay the full amount.

How about 'lost and found cash'? We have a thing here in the States(at least in Oregon) where if the owner can't be found,the cash along with the owners name is turned over to a bureau called 'Division of State Lands'. You can do an online search for your(or any other)name,or call them on the phone to get a list.
If your name is listed,you can send them an 'Unclaimed Property Inquiry' form along with proper I.D.(drivers license) and not required,but helps, Social Security Card copies. Also,something with the address they have listed like an old utility bill or envelope with the address on it. If valid,within 120 days the cash will be sent to you.
Said 'all that' to say this,,my Daughter was bored and did the online search just for grins and she found 'MY' name! I checked it out and sure 'nuff there i was! The address shown was one i hadn't lived at since 1987. Luckily,i still had ol' income tax forms with that address(born packrat). In the process now of getting the form notarized and will be sending it in shortly. It says the amount is 'over $50.00',but won't tell you the exact amount. Mine will probly be $50.01 :D But what the hey!,, after all this time it will be like 'pennies from heaven' anyways. And my Daughter's birthday is comin' up shortly,so only fair to 'share' huh?!

Hi, yes after the recent spate of corporate collapses in the US corporate governance has come under some review. Not before time too.Placing NON NEGOTIABLE on a cheque (note correct spelling) in Aus will force that payment to only be acceptable to the account payee (ie cheque can only be deposited in the payees account not to any third party). Situation is similiar to UK. No matter what you think of the bank remember the loser here(if the money were to be kept) is the system and ultimately all of us.
